Sharing information about the Dalai Lama\u2019s proposal for Tibetan \nautonomy is now a crime in Tibet under new measures aimed at turning \nTibetans against one another and criminalizing opinions contrary to \nChinese state propaganda. <\/p>\n\n\n\n

The \u201cMeasures for Reporting and Rewarding on the Campaign for \nEliminating Pornography and Illegal Content in the Tibet Autonomous \nRegion\u201d were promulgated on Sept. 12, 2019<\/a> but made public by state media only in late March 2020. <\/p>\n\n\n\n

According to the new measures, authorities are offering rewards to \nthose who report on individuals who advocate for a \u201cgreater Tibetan \narea,\u201d a \u201chigh degree of autonomy\u201d or the \u201cMiddle Way,\u201d including by \n\u201cpublishing, making, printing, reproducing, distributing, disseminating,\n mailing, storing and transporting publications (including online \npublications).\u201d<\/p>\n\n\n\n

The Middle Way is the Dalai Lama\u2019s proposal for genuine autonomy for Tibetans under Chinese rule. The US government and other world leaders have endorsed the plan. <\/p>\n\n\n\n

\u201cEndangering national unity\u201d<\/h4>\n\n\n\n

The new measures were formulated and tailored by TAR leadership to include specific references to Tibet, in accordance with those adopted at the national level in 2018<\/a>. The national measures were already very broad and all-encompassing, allowing Chinese authorities to treat anything published, posted online or broadcast\u2014other than official state propaganda\u2014as \u201cillegal\u201d and subject to punishment. <\/p>\n\n\n\n

Article 4 in Chapter II of the new measures stipulates as illegal any\n content in any form of publication that is found to be \u201cendangering \nnational unity, sovereignty and territorial integrity\u201d or \u201cattacking the\n system of regional national autonomy\u201d by advocating for a \u201chigh degree \nof autonomy\u201d and the Middle Way approach. <\/p>\n\n\n\n

The measures also target those individuals who criticize the overall \nChinese policy in Tibet. Chapter II, Article 4, Point 10 lists as \nillegal \u201cattacking the central government\u2019s strategies for governing \nTibet and the Party\u2019s ethnic and religious policies.\u201d <\/p>\n\n\n\n

Rewards will be given to those who report on individuals who copy or \ndistribute overseas publications, including on subjects related to \n\u201cTibetan independence.\u201d <\/p>\n\n\n\n

The measures list as criminal any attack or defamation of the Chinese\n Communist Party and state leaders, as well as any challenging of party \nleadership and China\u2019s socialist system. <\/p>\n\n\n\n

In effect, this criminalizes any legitimate criticism of the Chinese leadership and government. <\/p>\n\n\n\n

The measures, however, have no direct reference to the Dalai Lama. The most recent legal document that mentions him is the \u201cNotice of the Tibet Autonomous Region Public Security Department on Reporting Leads on Crimes and Violations by Underworld Forces,\u201d issued on Feb. 7, 2018. That notice calls the \u201cDalai clique\u201d one of the underworld forces that people should report to the authorities. <\/p>\n\n\n\n

Encouraging spying among Tibetans<\/h4>\n\n\n\n

The measures reinforce the subversive tactics China has long used \nagainst the Tibetan people to establish a systematic network of \ninformants, with the rewards and protection given to those informants \nspelled out clearly in its Articles 5, 7 and 11.<\/p>\n\n\n\n

Informants are promised a reward ranging from 1,000 yuan to 600,000 yuan depending on the type of information they provide.<\/p>\n\n\n\n

The new measures assure protection to the informants by concealment \nof their identity. It says further, \u201cNo unit or individual may retaliate\n against the reporter, and the offender shall be held accountable \naccording to law and discipline.\u201d<\/p>\n\n\n\n

The encouragement for Tibetans to inform on one another through the inducement of financial rewards further deepens and exacerbates tensions and distrust in Tibetan society, which are already at high levels because of the climate of oppression and total surveillance imposed by Beijing. These efforts foment suspicion and division in the community, reminiscent of the situation in Tibet during Chairman Mao\u2019s Cultural Revolution in the 1960s and 70s. The new measures build on a longstanding policy by the Chinese government to offer rewards for information on \u201cillegal content,” cash to informants and large rewards for information on the \u201cblack hand\u201d behind Tibetan self-immolations. The police in Tibet have also urged the public to report on loyalty to the \u2018evil forces\u2019 of the Dalai Lama. <\/p>\n\n\n\n

Denying autonomy for Tibetans<\/h4>\n\n\n\n

The Chinese government portrays the autonomy status granted to areas \nwhere Tibetans live as a success story, despite decades of \nwell-documented oppression and a lack of autonomy in any meaningful \nsense. <\/p>\n\n\n\n

China\u2019s institutional system is highly centralized, and it \nmethodically rejects the devolution of power and the granting of genuine\n regional autonomy to Tibetans. <\/p>\n\n\n\n

Instead of addressing the real issues at hand, Chinese Communist \nParty leaders in Tibet regularly denounce the Dalai Lama and his \nsupporters. For instance, on March 20, 2020, TAR Party Secretary Wu \nYingjie stated: <\/p>\n\n\n\n

We should actively promote rapid social economic development and \nlong-term social stability in Tibet, unswervingly implement the Central \nParty government\u2019s unified policy of fighting against 14th Dalai Clique,\n and Tibetan Buddhist devotees must firmly and resolutely draw a clear \nline with 14th Dalai Clique, and foster a sense of community in Chinese \nNation and consciously safeguard the reunification of the motherland and\n her nationality unity.<\/em><\/p>\n\n\n\n

China\u2019s determination of what is legal based on demanding loyalty \nonly to the state, the Communist Party and its policies violates the UN \nUniversal Declaration of Human Rights, in particular Article 19. <\/p>\n\n\n\n

China annexed Tibet, a historically independent country, more than 60 years ago, and today, Tibetans face constant human rights violations and live in one of the least free places on Earth. <\/p>\n\n\n\n

ICT recommendations<\/h4>\n\n\n\n

The International Campaign for Tibet calls for on China to revise the\n \u201cMeasures for Reporting and Rewarding on the Campaign for Eliminating \nPornography and Illegal Content in the Tibet Autonomous Region\u201d to bring\n them into conformity with international human rights law. <\/p>\n\n\n\n

Chinese authorities must also refrain from offering rewards to \nTibetans for possibly denouncing friends, neighbors and family members \nfor something that is protected by international human rights standards.\n <\/p>\n\n\n\n

To discuss a peaceful solution for the situation in Tibet, in publications or by other means, should not be a punishable crime.<\/p>\n","protected":false},"excerpt":{"rendered":"
